BellSouth Responds to Final Text of Triennial Review Remand Order9 February 2005
The following statement may be attributed to Jonathan Banks, BellSouth vice president - executive and federal regulatory affairs:
"BellSouth congratulates the Commission for issuing the order without further delay. "BellSouth applauds the Commission for its finding that CLECs are not impaired without access to unbundled local switching, as well as its finding that Unbundled Network Elements are not available to carriers for serving wireless and long-distance markets. "The Commission has elected to continue the discredited policies of mandating below-cost pricing of key parts of the communications network. These policies are fundamentally anticompetitive in the business market, which has long been recognized to be competitive. The FCC continues to require that we unbundle high-capacity loops and transport in a significant portion of our service territory, thereby enabling our competitors to obtain access to our network at a huge discount. Although the Commission granted some relief from unbundling of high-capacity loops and transport, BellSouth believes that the thresholds the Commission has set are simply too high.
"The Commission appropriately noted that the availability of unbundled local switching in combination with unbundled loops has given incentive to competitive carriers to NOT invest in their own facilities. The Commission, however, ignores the fact that continuing to require unbundled high-capacity loops and transport has the same result.
"As BellSouth stated in its earlier press release responding to the Commission’s vote on the Interim Rules Order, in those areas where we are no longer required to offer unbundled network elements, we will continue to work with our competitors to keep their traffic on our network, and we pledge a smooth transition to those who chose to move their traffic elsewhere. To-date, BellSouth has signed 35 commercial agreements."
